Privacy
The Customer's personal data provided either directly or indirectly to Agrif srl will be processed according and pursuant to Italian Legislative Decree no. 196/2003 (Privacy Code) with the provisions safeguarding persons and other subjects with reference to the processing of personal data and hence be used for the performance of the contract and obligations set forth by law or required by the competent authorities.
Legislative Decree no. 196/2003 is designed to ensure that the processing of personal data is carried out in compliance with the rights, fundamental liberties and dignity of all individuals.
Said data will be used by Agrif srl to wholly and correctly perform the contract and be disclosed to third parties for the safeguard of rights and for the performance of the obligations set forth by the law or regulations and required by competent authorities. The processing thereof will be inspired by the principles of correctness, lawfulness and transparency safeguarding the confidentiality and rights of Customers and third parties.
The following information is provided to the Customer according and pursuant to article 13 of Italian Legislative Decree no. 196/2003.
Processing by Agrif srl:
a) is aimed to enter into, manage and perform the provisions of the requested service contracts; to organize, manage and provide the services also by communicating data to third-party vendors; to meet the obligations of law or any other obligations set forth by the competent Authorities;
b) will be carried out electronically/manually;
c) save for what is strictly necessary for the proper execution of this supply contract, the data will not be communicated to other persons without the prior express consent of the Customer.
It should also be noted that the communication of personal data is not mandatory. It is necessary and essential though for the purpose of entering into this contract. Refusal to authorize processing will not allow Agrif srl to punctually and correctly provide the Service.
The data controller of the data provided by the Customer for the proper performance of the Cotract is Agrif srl S.p.A., with registered office in Via Ponte Di Mare 91, 90123 Palermo.
The Customer can contact the Data Controller to exercise his/her rights as set forth by Section 7 of Italian Legislative Decree no. 196/2003, whose text is provided below in full:
Section 7: Right to Access Personal Data and Other Rights:
1. A data subject shall have the right to obtain confirmation as to whether or not personal data concerning him exist, regardless of their being already recorded, and communication of such data in intelligible form.
A data subject shall have the right to be informed:
a) of the source of the personal data;
b) of the purposes and methods of the processing;
c) of the logic applied to the processing, if the latter is carried out with the help of electronic means;
d) of the identification data concerning data controller, data processors and the representative designated as per Section 5(2);
e) of the entities or categories of entity to whom or which the personal data may be communicated and who or which may get to know said data in their capacity as designated representative(s) in the State’s territory, data processor(s) or person(s) in charge of the processing.
2. A data subject shall have the right to obtain
a) updating, rectification or, where interested therein, integration of the data;
b) erasure, anonymization or blocking of data that have been processed unlawfully, including data whose retention is unnecessary for the purposes for which they have been collected or subsequently processed;
c) certification to the effect that the operations as per letters a) and b) have been notified, as also related to their contents, to the entities to whom or which the data were communicated or disseminated, unless this requirement proves impossible or involves a manifestly disproportionate effort compared with the right that is to be protected.
3. A data subject shall have the right to object, in whole or in part,
a) on legitimate grounds, to the processing of personal data concerning him/her, even though they are relevant to the purpose of the collection;
b) to the processing of personal data concerning him/her, where it is carried out for the purpose of sending advertising materials or direct selling or else for the performance of market or commercial communication surveys.
Consent to the processing of personal data
The Customer states that he has viewed the Information Sheet provided by Agrif srl S.p.A. according to article 13 of Italian Legislative Decee no. 196/2003 and hereby grants his consent to the processing of personal data for the purposes therein specified.
The Customer also states that he is aware that the failure to grant consent to processing may lead to the application of the provisions specified in said Information Sheet.
